This is the first time I have seen this document, and I can see why signing an EO that states this would be a concern to AI companies. Even though the EO says the reviews are voluntary, it sets an easy path for the government to change its mind and make them mandatory.

No it doesn't.

It is how it is because the law is how it is. It has to be voluntary because no lever for compulsion exists.

I'd actually like to see the admin try to force the issue, because the AI companies with their unlimited financial resources would have to defend the 1st ammendment and code-as-speech at the SCOTUS level which would be extremely important case law.

Actually, the most pro-free-speech thing the admin could do would be trying to regulate models, set such an action up only for it to fail by design and establish that as case law.

Nothing in this section shall be construed to authorize the creation of a mandatory governmental licensing, preclearance, or permitting requirement for the development, publication, release, or distribution of new AI models, including frontier models.
